Terms of Service

01Agreement

These Terms of Service (“Terms”) apply when you request a free sample, place an order or otherwise use the services of Clean Rows (“Clean Rows”, “we”, “us”). By doing so on behalf of a business, you confirm that you have authority to bind that business (“you”, “Customer”) to these Terms.

If you and we sign a separate written agreement, that agreement takes priority where it conflicts with these Terms.

02Business use only

Our services are for businesses and professionals acting in the course of business. They are not available to consumers for personal, family or household use.

03Our service

• Brief. You describe your ideal customer profile (ICP). We confirm what we can source before you pay.
• Free sample. We may provide up to 100 sample leads free of charge so you can check fit. One free sample per business, unless we agree otherwise.
• Order. An order is confirmed when we agree the criteria, volume and price in writing (email or WhatsApp is enough).
• Delivery. We deliver as a CSV file or Google Sheet. Delivery times on our website are typical estimates, not guarantees, and depend on the niche and volume.
• Recurring orders. If we agree a recurring delivery schedule, we confirm the scope and price before each delivery. There is no automatic renewal, and you can cancel any time before the next delivery starts.

04Data quality

We build each list from publicly available business sources, verify business emails with two verification services, remove duplicates and review files before delivery. However, business information changes constantly, so:

• we do not guarantee that every row is complete or accurate, or that any email address will stay deliverable
• mobile numbers are included only where publicly available, typically for around 50–60% of rows
• we do not guarantee any campaign result, such as open rates, replies, meetings or sales

05Your responsibilities

You are responsible for how you and anyone acting for you use the data. You agree to:

• comply with all laws that apply to your outreach, including the UK and EU GDPR, the UK PECR and EU ePrivacy rules, the US CAN-SPAM Act, the Telephone Consumer Protection Act and do-not-call rules, Canada’s CASL, Australia’s Spam Act, and state privacy laws
• give each person the information the law requires when you first contact them, including who you are and where you got their details
• include a working opt-out in every message and honour opt-outs promptly
• check phone numbers against do-not-call registers before calling or texting where the law requires it
• follow the terms of any platform you use, such as LinkedIn
• remove anyone from your copy of the data within 10 business days after we tell you they have asked to be removed
• keep the data secure and delete it when you no longer need it

06Prohibited uses

You must not use data from Clean Rows:

• to decide anyone’s eligibility for credit, insurance, employment, housing or any other purpose covered by the US Fair Credit Reporting Act or similar laws
• to harass, stalk, threaten or discriminate against anyone
• to market to people in a personal or consumer capacity
• to send bulk unsolicited messages that break anti-spam laws
• for any unlawful, fraudulent or deceptive purpose

07Licence to use the data

When you have paid for a list, we grant you a non-exclusive, non-transferable, perpetual licence to use it for your own B2B sales, marketing and research. Agencies may use a list to run campaigns on behalf of their clients.

You may not sell, license, publish or otherwise distribute the data as a dataset, or combine it into a database you make available to others. Lists are not exclusive: the same professional may appear in lists we build for other customers.

08Prices and payment

• Prices are in US dollars and are shown on our website or in a written quote.
• Unless we agree otherwise in writing, paid orders are payable in advance, before we start the full build.
• We accept bank transfer, PayPal, Wise and Remitly. You pay any fees your bank or payment provider charges you.
• Prices do not include taxes. You are responsible for any taxes, duties or withholding that apply to your purchase, other than taxes on our income.
• Quoted prices for recurring orders stay fixed for the period we agree in writing.

09Rebuilds and refunds

Our Refund Policy forms part of these Terms. It explains when we rebuild a list for free or give a refund.

10Confidentiality

We keep your brief, ICP, target accounts, exclusion lists and order details confidential. We do not sell, share or resell them, and we use them only to deliver your orders. You agree to keep our pricing quotes and non-public information about our methods confidential.

11Warranties

We will provide our services with reasonable skill and care. Apart from that and anything else stated in these Terms, the data and services are provided “as is”, and we exclude all other warranties to the extent the law allows, including warranties of accuracy, completeness and fitness for a particular purpose.

12Limitation of liability

To the extent the law allows:

• our total liability arising from any order is limited to the amount you paid us for that order
• we are not liable for indirect or consequential loss, or for lost profits, revenue, business or data

Nothing in these Terms limits liability for fraud, or for anything else that cannot be limited by law.

13Indemnity

You will compensate us for claims, fines and reasonable costs we suffer because you, or anyone acting for you, used the data in breach of these Terms or the law.

14Suspension and termination

We may decline an order, or suspend or end our services, if we reasonably believe you are using or plan to use the data unlawfully or in breach of these Terms. Sections on your responsibilities, prohibited uses, licence limits, confidentiality, liability and indemnity continue after our relationship ends.

15Changes to these Terms

We may update these Terms. The version on this page when you place an order applies to that order. We will tell recurring customers by email before a material change takes effect.

16Governing law and disputes

These Terms are governed by the laws of India. If a dispute arises, please email hello@cleanrows.com first: we will try to resolve it within 30 days. If we cannot, the courts of India have jurisdiction.
